摘要: 隨著數(shù)據(jù)成為核心生產(chǎn)要素,數(shù)據(jù)要素市場(chǎng)展現(xiàn)出前所未有的活力與潛力。然而,伴隨其快速發(fā)展,相關(guān)制度滯后性逐漸顯現(xiàn)。深入剖析了當(dāng)前數(shù)據(jù)要素市場(chǎng)主體功能定位模糊、責(zé)權(quán)劃分不清問題,結(jié)合現(xiàn)有的制度文件分析了當(dāng)前數(shù)據(jù)要素交易市場(chǎng)中的交易主體功能定位。在此基礎(chǔ)上,借鑒傳統(tǒng)市場(chǎng)與金融證券行業(yè)的先進(jìn)經(jīng)驗(yàn),提出了數(shù)據(jù)交易主體分類管理的創(chuàng)新機(jī)制,旨在通過明確主體分類、細(xì)化管理要求、強(qiáng)化跨部門協(xié)同等措施,為數(shù)據(jù)交易市場(chǎng)的規(guī)范、安全、高效運(yùn)行提供有力保障,進(jìn)一步激發(fā)數(shù)字經(jīng)濟(jì)活力。

Exploration of innovative management mechanisms for trading entities in data trading market

Abstract: As data has become the core factor of production, the data factor market has shown unprecedented vitality and potential. However, with its rapid development, the lag of relevant systems has gradually emerged. This paper deeply analyzes the current problems of ambiguous functional positioning of data element market entities and unclear division of responsibilities and rights, and analyzes the functional positioning of trading entities in the current data element trading market in combination with the existing institutional documents. On this basis, drawing on the advanced experience of the traditional market and the financial and securities industry, this paper proposes an innovative mechanism for the classification and supervision of data trading entities, aiming to provide a strong guarantee for the standardized, safe and efficient operation of the data trading market and further stimulate the vitality of the digital economy by clarifying the classification of entities, refining regulatory requirements, and strengthening cross-departmental coordination.

引言

隨著信息技術(shù)的迅猛發(fā)展和數(shù)字化轉(zhuǎn)型的深入推進(jìn),數(shù)據(jù)已成為驅(qū)動(dòng)經(jīng)濟(jì)社會(huì)發(fā)展的關(guān)鍵生產(chǎn)要素[1]。然而,與傳統(tǒng)商品交易相比,數(shù)據(jù)交易具有其獨(dú)特的復(fù)雜性和挑戰(zhàn)性,如數(shù)據(jù)的可無限復(fù)制性[2]、權(quán)屬劃分的模糊性[3]以及交易過程中的高風(fēng)險(xiǎn)性[4]等,這些特殊性使得完善數(shù)據(jù)交易市場(chǎng)主體管理制度、確保數(shù)據(jù)交易活動(dòng)的合法合規(guī)面臨一定的困難。

當(dāng)前,我國部分地方政府已通過制定地方性文件來規(guī)范數(shù)據(jù)交易市場(chǎng)的主體行為。然而這些地方性文件在應(yīng)對(duì)數(shù)據(jù)交易特殊性方面仍顯不足,特別是對(duì)于數(shù)據(jù)交易主體功能的精準(zhǔn)定位以及精細(xì)化分類管理方面尚需進(jìn)一步探索和完善。

基于此,本文通過借鑒相關(guān)領(lǐng)域的研究成果和實(shí)踐經(jīng)驗(yàn),結(jié)合我國數(shù)據(jù)交易市場(chǎng)的實(shí)際情況,開展以下幾方面的工作:首先,明確數(shù)據(jù)交易主體的功能定位,清晰界定各類主體在數(shù)據(jù)交易過程中的角色與職責(zé);其次,梳理當(dāng)前數(shù)據(jù)交易市場(chǎng)中交易主體管理存在的問題;構(gòu)建數(shù)據(jù)交易主體能力評(píng)價(jià)體系,從市場(chǎng)影響力和數(shù)據(jù)安全保障能力兩個(gè)維度出發(fā),全面評(píng)估數(shù)據(jù)交易主體的綜合能力;最后,基于能力評(píng)價(jià)體系構(gòu)建精細(xì)化分類管理機(jī)制,針對(duì)不同類型、不同能力的數(shù)據(jù)交易主體實(shí)施差異化管理策略,以提升管理的針對(duì)性和有效性。

綜上所述,本文的研究有助于深化對(duì)數(shù)據(jù)交易特殊性及其管理需求的理解,為完善我國數(shù)據(jù)交易市場(chǎng)的主體管理制度提供了新思路和新方法。
